The proposed Regulations Amending Certain Regulations Made Under the Canada Consumer Product Safety Act (Surface Coating Materials) published in Canada Gazette, Part I on Apr 24th, 2021. This draft resolution mainly aims to amend requirements of Surface Coating Materials. The proposed amendments intend to:
█ Expanding the meaning of a surface coating material to include surface coating materials that do not “dry” on application, such as powder coatings that are applied electrostatically, and other decorative surface coating materials that may be applied to products during manufacture, such as stickers or films.
█ Introducing a 90 mg/kg total lead limit in surface coating materials applied to furniture.
█ Removing the restrictions on lead, mercury and certain other harmful elements in surface coating materials applied to parts of products that are inaccessible.
█ Removing an outdated test method for certain harmful elements in applied surface coating materials.
Affected consumer products include products for children and household furniture etc. In line with the implementation of the above proposal, the following CCPSA regulations will be amended in part.
A. SOR/2016-193 the Surface Coating Materials Regulations
Ⅰ) The definition surface coating material and accessible part will be replaced by the following:
(a)Surface coating material: means a paint or other similar material, with or without pigment, that forms a solid film after it is applied to a surface and that can be removed. (b)Accessible part: means any part of a product that may be touched, licked, mouthed or swallowed during the reasonably foreseeable use of the product.
Ⅱ) Revised scope of products limited total lead (90mg/kg):
(a) Furniture.
(b) Products for children.
(c) Pencils, and
(d) Artist brushes.
B. Regulations on products for infants and children:
SOR/2011-17 the Toys Regulations
SOR/2016-152 the Cribs, Cradles and Bassinets Regulations
SOR/2016-179 the Expansion Gates and Expandable Enclosures Regulations
SOR/2018-186 the Playpens Regulations
Ⅰ) Definition of accessible part and surface coating material has the same meaning as in the Surface Coating Materials Regulations.
Ⅱ) A sticker, film or other similar material that can be removed, or a surface coating material, that is applied to an accessible part of a playpen or accessory must not contain, when it is tested in accordance with a method that conforms to good laboratory practices,
(a) more than 90 mg/kg total lead,
(b) any compound of antimony, arsenic, cadmium, selenium or barium if more than 1000 mg/kg of the compound migrates from the material, or
(c) more than 10 mg/kg total mercury.
Ⅲ) The old test methods specified in the relevant regulations will be deleted and modified to allow any test method that complies with good laboratory practice to be used for testing.
These Regulations come into force on the 180th day after the day on which they are published in the Canada Gazette, Part II.
CTT reminds that if products exported to Canada (especially baby products, furniture, etc.) involve surface coating materials, the raw materials and supply chain shall be controlled in advance to ensure products export and trade smoothly.
