On June 2, 2025, the Swiss Federal Office for Food Safety and Veterinary Affairs (FSVO) issued RO 2025 395, revising RS 817.023.21, the "Regulations on Food Contact Materials and Articles". It is prohibited to use bisphenol A and bisphenol substances in the varnishes and coatings used for food contact.This regulation came into effect officially on July 1, 2025.
The specific revisions are as follows:
1. The ban requires:
(1) It is prohibited to use bisphenol A and its salts in the varnishes and coatings used for food contac.
(2) Food contact materials and products produced using other harmful bisphenols and their derivatives must not contain bisphenol A.
(3) It is prohibited to use any harmful bisphenols or their derivatives other than bisphenol A in food-contact varnishes and coatings.
(4) To ensure compliance, extraction methods should be adopted, and the detection limit of the method should reach 1μg/kg (1ppb).
2. Exemption conditions:
Bisphenol A, as a monomer or starting material for liquid epoxy resins, is exempted when used to manufacture self-supporting materials or objects with a capacity of more than 1000 liters. However, such applications still need to meet the conditions that the migration amount must not be detectable (Detection limit 1 μg/kg) and the final product must be cleaned and rinsed before its first contact with food.
3. Transition Period:
To ensure a smooth transition of the industry, the new regulations have set a transition period identical to the EU regulation (EU) 2024/3190.
Products that comply with the old regulations for one-time food contact materials and reusable items containing bisphenol A can be imported, manufactured, labeled and put on the market before July 20, 2026.
For professional food production equipment, this period can be extended to January 20, 2028. While reusable items that were first placed on the market according to the old regulations can continue to be sold on the market until January 20, 2029.
