California recently introduced SB 1266, revised sections 108940 and 108941 of the Health and Safety Code and to add section 108942. Prohibit bisphenol, perfluoroalkyl or polyfluoroalkyl substances in children’s feeding product and children's sucking or teething product, unless the substances are temporarily essential chemicals. The revised bill is scheduled to come into effect on January 1, 2025.
The definitions of the two types of children's products controlled in the bill are as follows:
Children's feeding product: consumer product is designed or intended to be filled with any liquid, food, or beverage intended primarily for consumption from that bottle or cup by children younger than 12 years of age.
Children's sucking or teething product: consumer product is designed or intended to help a child younger than 12 years of age with sucking or teething in order to facilitate sleep or relaxation.
The comparison between the key revised content of this bill and the current requirements is as follows:
* “Temporarily essential chemical” means a chemical for which all of the following are true:
(1)There are no safer alternatives to the chemical available.
(2)The chemical is necessary for the product to work as intended.
(3)The chemical is being used in a product that is critical for the health, safety, or function of society.
