The EU intends to amend the Toy Safety Directive (2009/48/EC)

On August 11, 2026, the World Trade Organization (WTO) issued notification G/TBT/N/EU/1231, stating that the European Commission intends to amend the relevant content regarding allergenic fragrances, bisphenol A, phenol, and 1,2-benzisothiazolin-3(2H)-one (BIT) in Annex II of the EU Toy Safety Directive 2009/48/EC.

The draft will initiate a 60-day public consultation from the date of notification, with the deadline for feedback set on October 10, 2026. It is suggested that the proposal will be adopted and take effect in the fourth quarter of 2026.

The proposed revisions are as follows:

The revision of the Toy Safety Directive marks a further tightening of the EU's toy safety regulatory system. Relevant enterprises should closely monitor the subsequent developments of the draft and formulate effective response strategies in advance to ensure product compliance.

It is worth noting that the EU Toy Safety Regulation(EU) 2025/2509 (TSR) came into effect on January 1, 2026, but with a transition period of up to 55 months. The current Directive 2009/48/EC remains valid during this period and will not be repealed until August 1, 2030. In addition, supporting systems such as the Digital Product Passport (DPP) have not yet been implemented. During this period, the EU continues to revise the current Directive, gradually aligning chemical safety limits with the TSR, providing clearer compliance guidelines for enterprises to achieve a smooth transition.
