Germany to fine those violate REACH with new regulation

Recently, German Federal Environment Agency carried out a new regulation specifying penalty to those violating relevant requirement under REACH.

Beginning from 01.05.2013, when the only representative fails to provide correct and complete information according to REACH for relevant product in a timely manner, he will face a fine of up to € 50,000. When products fail to be compliant with relevant stipulation under REACH Annex XVII, the only representative will face a penalty of up to 2 years imprisonment. But if common public are exposed under grave risks coming out with these violations, the only representative will face a penalty of up to 5 years imprisonment.

REACH is a mandatory law to precautionarily control chemicals that may enter into EU market. For the sake of human health and environmental protection, it requires manufacturers, importers and down-stream users to be responsible for safety use of chemical under a complicated system of chemical control.

The REACH Annex XVII now regulates 63 kinds of hazardous substances. While a product contains a relevant hazardous substance in a concentration greater than the limit specified under Annex XVII, it is not allowed to put into the market of EU.

For SVHC, when the following tow conditions are met, the only representative shall notify information of the SVHC in the product to EU authority: 1.Chemicals in “Candidate List” of SVHC. 2.Volume of a chemical exported into EU > 1 ton/year and Content of this chemical in articles > 0.1% (W/W).
